Adoption is a meaningful step that creates a permanent legal relationship between a child and their adoptive parent or parents. While the process can be exciting, it also involves specific legal requirements, documents, and court procedures that must be completed carefully.
Adoptions
Adoption permanently transfers parental rights and responsibilities to the adoptive parent or parents, establishing a new legal parent-child relationship.
Every adoption has its own circumstances. At Richmond Tymchuk Family Law LLP, we take the time to understand your family, explain what the process requires and help you complete the necessary legal steps with clarity and care.
01
There are several paths to adoption in Alberta. Depending on your circumstances, these may include:
Our lawyers have plenty of experience assisting clients with step-parent, relative and spousal adoptions, private direct placements and adoptions involving licensed agencies.
02
For some families, adoption formalizes a relationship that has already existed for years.
A step-parent may wish to become the legal parent of their spouse’s child, while grandparents or other relatives may seek to establish a permanent legal relationship with a child already in their care.
Alberta treats step-parent and relative adoptions as forms of private adoption. These applications are made through the Court of King’s Bench and require specific documents, notice requirements and supporting information. Our lawyers can help you understand what is required and guide you through each stage of the application.
03
The exact process depends on the type of adoption, but private direct, step-parent and relative adoptions generally require an application to the Court of King’s Bench.
The process can include preparing the required forms and supporting documents, filing the application, serving required parties and submitting proof of service. A judge then reviews the application and may grant an Adoption Order, request additional information, order a Home Study Report or require a hearing.
We can ensure that your application is prepared carefully and that you understand what to expect as your matter moves forward.
04
Adoption permanently changes legal parental relationships, so Alberta law includes requirements designed to ensure the appropriate people receive notice and that the proposed adoption is properly considered.
For private adoptions, you may need to serve notice on existing guardians, a biological parent, Alberta Children and Family Services, and, in some cases, the child. For example, Alberta requires serving a child aged 12 or older with the adoption application in private adoption proceedings.
Adoption should be about building and strengthening your family, not feeling overwhelmed by legal paperwork and procedure. Richmond Tymchuk Family Law LLP is here to take you through the requirements, prepare your application and move through the process with clear, experienced support.
