Family Law Services
Divorce can affect your family, finances, home and plans for the future. Experienced legal guidance can help you understand what needs to be resolved, protect your interests, and make informed decisions at every stage.
Divorce
Every divorce is different. Some spouses are able to agree on the major issues and move through the process without significant conflict. Others face disagreements involving children, support, property, businesses or complex financial interests.
Richmond Tymchuk Family Law LLP helps clients navigate both uncontested and contested divorces, focusing on resolving matters constructively where possible and providing strong representation when litigation becomes necessary.
01
Under Canada’s Divorce Act, a divorce can be granted when a marriage has broken down. This can be established through one year of separation, adultery, or physical or mental cruelty. Separation is the most commonly used ground, and spouses can begin the divorce process before the full year has passed, although the divorce cannot be granted on that basis until the one-year separation requirement has been met.
02
An uncontested divorce may be possible when spouses have resolved issues such as parenting and support and neither party is opposing the divorce. Alberta’s Court of King’s Bench provides a desk divorce process for uncontested matters, although its divorce forms do not resolve property division.
When spouses cannot agree on important issues, the divorce becomes more complex. Our lawyers can help you work through disputes involving parenting, child and spousal support, property division and other matters through negotiation, mediation, arbitration or litigation where necessary.
03
Obtaining the divorce itself is only one part of ending a marriage. You may also need to make important decisions about your children, finances and property.
At Richmond Tymchuk Family Law LLP, we provide guidance on matters including parenting arrangements, child support, spousal support, division of family property, separation agreements and complex financial interests. Our team considers how these issues connect so your overall strategy reflects both your immediate concerns and your longer-term interests.
04
Not every divorce needs to become a courtroom battle. We look for practical opportunities to resolve disputes through negotiation, mediation and arbitration when those processes are appropriate.
When an agreement cannot be reached, our lawyers bring substantial litigation experience and have represented clients through complex family law disputes. The firm’s lawyers have been involved in more than 40 reported family law decisions, supported by experienced senior counsel and a collaborative legal team.
Work with a Calgary family law team that brings senior counsel, extensive litigation experience and thoughtful dispute resolution to your divorce. Richmond Tymchuk Family Law LLP will help you understand what comes next and provide the support and strategy you need throughout the process.
