Family Law Services
Our Calgary divorce lawyers are well equipped to take matters to court to fight for you and your rights, but it is often quicker and more cost-effective to settle your divorce out of court.
Arbitration & Mediation
Reaching a mutual agreement on all issues can be difficult during a divorce. When divorcing parties cannot agree, they may involve a third party to help reach a resolution that satisfies everyone.
Family law disagreements do not always need to go to court. Arbitration and mediation offer structured alternatives for addressing parenting, support, property and other family law issues while giving you greater control over the process. At Richmond Tymchuk Family Law LLP, our partners, Laurie J. Tymchuk and Erin A.L. Townley, are professionally trained mediators and arbitrators who bring dedicated dispute resolution experience to help you find a practical path forward.
01
Our lawyers bring experience in negotiation, mediation, arbitration and litigation. We help you understand the issues that need to be resolved, prepare for the process and develop a strategy that reflects your priorities and long-term interests.
Our focus is not simply on avoiding court. It is on finding the process that gives you the best opportunity to reach a fair, practical and lasting outcome.
02
Mediation brings both parties together with a neutral mediator who helps identify the issues, encourages productive discussion, and explores possible solutions. The mediator does not decide the outcome or force either party to accept a settlement. The parties remain responsible for deciding whether they can reach an agreement.
For families who can participate constructively, mediation can provide a more cooperative setting to discuss matters such as parenting arrangements, child and spousal support, property division, and the terms of separation.
Our lawyers can help you prepare for mediation, understand your legal position and evaluate proposed terms before you make important decisions.
03
Arbitration provides a more decision-focused alternative when the parties cannot reach agreement themselves. A neutral arbitrator hears the evidence and arguments relating to the issues submitted for arbitration and makes a decision that is generally binding on the parties.
This process can be particularly useful when a matter needs a clear resolution, but the parties would prefer an alternative to traditional court proceedings.
04
The right approach depends on the level of conflict, the issues in dispute and each party’s willingness and ability to reach an agreement.
Mediation may be appropriate when both parties want to participate in finding their own resolution. Arbitration may be better suited to matters where negotiations have stalled, and an independent decision is needed.
Our lawyers will walk you through the advantages and considerations of each process so you can make an informed decision about how to proceed.
If mediation or arbitration may be the right path for your family law matter, you can retain Laurie J. Tymchuk and Erin A.L. Townley directly as mediators and arbitrators. Both bring formal professional training in dispute resolution, helping parties navigate difficult issues, find common ground where possible and reach practical resolutions outside the courtroom.
